Shipping policy

Shipping and Delivery The furniture sold under this Agreement is skillfully created by independent craftsmen located within the United States. Each piece is custom-made specifically for the Buyer and is produced only after receipt of the required deposit.

Once the custom order is completed by the craftsman, Seller will arrange shipping with its partner shipping company. The partner shipping company will contact Buyer directly to arrange the final delivery date and time. Delivery and any assembly services are available only if Buyer selects and pays for White Glove Delivery at the time of order. Standard delivery does not include assembly. Buyer (or a Buyer-designated representative named in advance and approved by Seller and the delivery firm) must be present at the delivery address to accept delivery and sign the carrier’s delivery receipt, bill of lading, or other acceptance document prior to unloading or unpacking the goods. If Buyer or the approved representative is not present or refuses to sign acceptance, delivery may be refused or rescheduled at Buyer’s expense, and additional fees (including redelivery and storage) will apply.

Risk of loss passes to Buyer upon Seller’s tender of the goods to the third-party carrier (shipment contract under 13 Pa.C.S. § 2509(1)(a)), unless otherwise specified herein. Seller is not liable for delays caused by carriers, manufacturers, weather, or other events beyond Seller’s control (force majeure). Additional delivery charges apply if rescheduled due to Buyer’s unavailability or other Buyer-related issues. If Buyer delays acceptance beyond the scheduled date, Buyer pays Seller’s reasonable storage costs. Buyer must inspect the goods immediately upon delivery as set forth in Section 6.

Inspection and Acceptance Buyer must inspect the goods immediately upon delivery. By signing the carrier’s delivery receipt, bill of lading, or other delivery document (whether signed by Buyer or approved representative), Buyer accepts the goods in the condition delivered unless any visible damage, shortage, or nonconformity is expressly noted in writing on that document at the time of signature. Failure to note any visible issue at delivery constitutes acceptance of the goods as conforming and in satisfactory condition (13 Pa.C.S. § 2606).

Buyer must immediately notify the third-party delivery firm of any visible damage, shortage, or nonconformity in accordance with the delivery firm’s policy (which may require notation on their forms or immediate verbal/written report to the driver/crew). Buyer must also notify Seller in writing (via email or certified mail) of any such issue within 24 hours after delivery.

Any claim for concealed defects must be reported to Seller prior to signing the shippers acceptance documents. Failure to provide notice to Seller of visible or concealed issues as required herein constitutes final acceptance of the goods as conforming and satisfactory, and waives all claims related thereto (13 Pa.C.S. § 2607). Buyer bears the burden of proof for any breach with respect to accepted goods.
